1. DEFINITIONS


As used in this Agreement, the following terms have the meanings set forth below:


"Agreement" means all terms and conditions contained in this form, any addenda, and any additional materials provided by us at the time of reservation or rental.


"You" or "your" means the person identified as the renter on this form, any person signing this Agreement, and any person or organization to whom charges are billed by us at the direction of the renter. All persons referred to as "you" or "your" are jointly and severally bound by this Agreement.


"We," "our," or "us" means Amanda's Adventures LLC, a Wisconsin limited liability company doing business as Amanda's Glamping.


"Trailer" means the non-motorized camping trailer identified in this Agreement.


"MotorHome" means the motorized camping vehicle identified in this Agreement.


"Rental Unit" means the Trailer or MotorHome designated in this Agreement, as applicable.


"Loss of Use" means our loss of the right to use the Rental Unit due to damage or loss occurring during your rental period. Loss of Use is calculated by multiplying the number of days from the date of damage or loss until the Rental Unit is repaired or replaced by the applicable daily rental rate.


"Rental Location" means the campsite or other location identified in this Agreement as the delivery and placement address for the Rental Unit.



2. RENTAL; INDEMNITY; DISCLAIMER OF WARRANTIES


This Agreement governs the temporary use of the Rental Unit at the Rental Location. This Agreement does not grant you or any other party the right to tow, drive, or otherwise move the Rental Unit from the Rental Location.


UNAUTHORIZED MOVEMENT OF THE RENTAL UNIT IS STRICTLY PROHIBITED and will result in, at a minimum, forfeiture of the Security Deposit and may result in legal action, including a claim for theft or conversion.


We reserve the right to repossess the Rental Unit at your expense, without prior notice, if the Rental Unit is abandoned or used in violation of any applicable law or this Agreement.


You agree to indemnify, defend, and hold harmless Amanda's Adventures LLC, its members, managers, employees, and agents from and against all claims, liabilities, damages, costs, and attorneys' fees arising out of or related to this rental or your use of the Rental Unit.


WE MAKE NO WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, REGARDING THE RENTAL UNIT, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE RENTAL UNIT IS PROVIDED "AS IS."



3. CAMPGROUND RESERVATIONS


We are not responsible for campground reservations. All campground reservations must be made separately and directly with the applicable campground or reservation agency. All campground and campsite fees are in addition to the rental fees under this Agreement. No refunds will be given for campground reservation errors.


3.1 Electrical Requirements


It is your sole responsibility to ensure that your campsite provides adequate electrical power for full and safe use of the Rental Unit. The amperage requirement for your specific Rental Unit is set forth on your invoice. Amanda's Adventures LLC is not responsible for reduced operation of the Rental Unit caused by inadequate campsite power. Only power cables provided by Amanda's Adventures LLC may be used. No third-party or personal power cables are permitted.


3.2 Site Selection


It is your sole responsibility to select a campsite of adequate size to accommodate the full length and width of the Rental Unit, including any slide-out extensions. The dimensions of the Rental Unit and the number and location of any slides will be provided on your quote and invoice. Amanda's Adventures LLC is not responsible if a campsite proves inadequate in size. No refunds or remedies will be provided if the campground is unable to offer an alternative site during your rental period.



4. CHECK-IN


Deliveries are generally scheduled between 2:00 p.m. and 5:00 p.m. on each rental start date. It is your responsibility to call us at (920) 843-5007 on the Rental Period Start Date to check in and receive your scheduled delivery window. Delivery times are assigned on a first-come, first-served basis.



5. DELIVERY, SETUP, AND PICKUP


We will deliver and set up the Rental Unit at the Rental Location on the Rental Period Start Date and retrieve the Rental Unit upon conclusion of your rental period. At delivery, a staff member will provide an orientation covering the safe and proper operation of the Rental Unit, its features, and a summary of prohibited uses. Instruction materials will be provided inside the Rental Unit. Please allow up to one (1) hour for the orientation.


There are no refunds for early departures for any reason.


The Rental Unit must be returned free of damage and in a clean condition. "Clean condition" means, at a minimum: dishes washed, dried, and put away; all trash removed; floors swept; and countertops wiped clean. Failure to return the Rental Unit in the required condition will result in additional cleaning and/or repair charges, which may be deducted from the Security Deposit. Any remaining balance beyond the Security Deposit may be charged to the credit card on file.


If incorrect delivery information is submitted through the reservation request form and results in delivery to the wrong date or location, a fee of $100.00 will be automatically deducted from your Security Deposit to offset travel costs and time incurred.



6. RENTER IDENTIFICATION


A valid, government-issued driver's license from your country of residence must be presented at the time of rental. The license must remain valid through the entire rental period. If the license is issued in a language other than English, an International Driving Permit or other form of identification acceptable to us is recommended.



7. ACCEPTABLE FORMS OF PAYMENT


Rental fees, holding deposits, and security deposits may be paid online using the payment method specified in your invoice (debit card or credit card). We do not accept personal checks.



8. PROHIBITED USES


The following acts and uses are strictly prohibited and constitute a material breach of this Agreement, which may result in, without limitation, forfeiture of the Security Deposit, immediate repossession of the Rental Unit, and/or legal action:


(a) Towing, driving, or otherwise moving the Rental Unit from the Rental Location without our express written authorization;

(b) Accessing or walking on the roof of the Rental Unit;

(c) Failing to comply with all campground rules and regulations; and

(d) Violating any applicable federal, state, or local law.



9. PERSONAL PROPERTY


TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE AND HOLD HARMLESS AMANDA'S ADVENTURES LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS FROM ALL CLAIMS FOR LOSS OF OR DAMAGE TO YOUR PERSONAL PROPERTY OR THAT OF ANY OTHER PERSON THAT IS LEFT OR CARRIED IN OR ON THE RENTAL UNIT OR IN OUR OFFICES, WHETHER OR NOT SUCH LOSS OR DAMAGE WAS CAUSED BY OUR NEGLIGENCE OR WAS OTHERWISE OUR RESPONSIBILITY.



10. PERSONAL INJURY; LIABILITY LIMITATION


TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE AND HOLD HARMLESS AMANDA'S ADVENTURES LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS FROM ALL CLAIMS FOR PERSONAL, BODILY, OR MENTAL INJURY, ECONOMIC LOSS, OR ANY OTHER DAMAGES SUSTAINED BY YOU, YOUR GUESTS, OR ANY THIRD PARTIES, WHETHER OR NOT CAUSED BY USE OF THE RENTAL UNIT, OUR NEGLIGENCE, OR OTHERWISE.


Nothing in this Agreement limits liability that cannot be disclaimed or limited under applicable Wisconsin law, including liability for gross negligence or willful misconduct.



11. NO SMOKING OR VAPING


Smoking and vaping of any substance are strictly prohibited inside the Rental Unit. If the Rental Unit is returned with any odor attributable to smoking or vaping, you will forfeit the full Security Deposit, and additional charges for cleaning and/or repair may be assessed to the credit card on file.



12. PET POLICY


Pets are not permitted inside the Rental Unit unless expressly approved by us in writing prior to your rental period. If a pet is approved, any damage caused by the pet will be deducted from the Security Deposit, and additional charges may apply if damages exceed the Security Deposit amount.



13. ONBOARD SUPPLIES AND UTILITIES


Most Rental Units are equipped with oversized tanks: approximately ninety (90) gallons of fresh water capacity, ninety (90) gallons of gray and black water holding tank capacity, thirty (30) pounds of propane, and two (2) fully charged 12-volt batteries. Some Rental Units have standard-size tanks. Actual capacities will be noted on your invoice.


It is your sole responsibility to manage these resources so they last the entire rental period. We will not supply additional water, holding tank capacity, propane, or batteries during your rental period.



14. GENERATOR


The Rental Unit may be equipped with a gasoline-powered generator that supplies 120-volt AC power to interior outlets, the microwave oven, and the roof air conditioner. The generator can also be used to recharge the 12-volt battery bank.


Trailers: The generator tank holds approximately four (4) gallons of gasoline at the start of your rental. A fuel can is provided. It is your responsibility to refuel the generator as needed.


MotorHomes: The generator shares the primary fuel tank. The generator is designed not to draw fuel below the 1/4-tank mark on the gauge. The MotorHome will be delivered with a full tank of fuel.



15. APPLIANCES AND CONVENIENCE ITEMS


The air conditioner, generator, awning, radio, microwave, television, leveling jacks, and similar features are provided as convenience items. If any such item malfunctions during your rental period, no compensation or rental credit will be provided. For assistance, consult the instruction materials inside the Rental Unit or contact us at (920) 843-5007.



16. RENTER RESPONSIBILITY FOR DAMAGE


You are responsible for all damage to the Rental Unit and its contents that occurs during your rental period, regardless of fault, including damage caused by acts of nature (e.g., wind, rain, hail, flood, fire, or earthquake). At the conclusion of your rental period, we will inspect the Rental Unit and provide an estimate of any damage.


In the event of an accident, collision, or incident involving the Rental Unit or a third party, you are responsible for: (i) obtaining a police report; (ii) collecting the other party's insurance information, if applicable; and (iii) notifying us immediately at (920) 843-5007.


16.1 Awnings


Use of the exterior awning is permitted but is at your own risk. Awnings are not covered by our insurance. Any damage to the awning — including damage caused by weather events or renter negligence — is 100% your financial responsibility. Awning replacement costs typically exceed $2,500 and will be charged in addition to the Security Deposit if applicable.



17. EARLY DEPARTURES AND RENTAL EXTENSIONS


Please review this Agreement carefully to confirm that all rental dates and charges are correct. There are no refunds for early departures for any reason.


If you wish to extend your rental period, you must contact us in advance for approval. If you do not vacate the Rental Location by the scheduled checkout time on the Rental Period End Date and have not received prior approval to extend, you will be charged for each additional rental day, plus any fees or costs incurred by the next scheduled renter as a result of the delay.



18. WAIVER


Our failure to enforce any right under this Agreement or at law shall not constitute a waiver of that right or any other right, unless such waiver is expressly made in writing and signed by an authorized representative of Amanda's Adventures LLC.



19. GOVERNING LAW AND VENUE


This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict-of-law principles. The parties irrevocably consent to the exclusive jurisdiction of the state courts of Wisconsin or the United States District Court for the Eastern District of Wisconsin for any dispute arising under or related to this Agreement, and each party waives any objection to the laying of venue in such courts.



20. SEVERABILITY


If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions shall continue in full force and effect.



21. ATTORNEYS' FEES


In the event of a dispute arising from or related to this Agreement, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs, in addition to any other relief awarded.



22. MODIFICATIONS


No term of this Agreement may be waived or modified except by a written instrument signed by an authorized representative of Amanda's Adventures LLC.



23. ENTIRE AGREEMENT


This Agreement, together with the invoice and any written addenda, constitutes the entire agreement between the parties with respect to the rental of the Rental Unit and supersedes all prior oral or written agreements and understandings relating to the same subject matter. This Agreement may be amended only by a written instrument signed by all parties.



24. NO-REFUND POLICY


Except as expressly stated in this Agreement, no refunds will be issued for any reason, including but not limited to inclement weather, no-shows, late arrivals, or early departures.



25. INSURANCE REQUIREMENT


You are required to maintain liability insurance coverage for the entire duration of your rental period. Proof of insurance must be obtained no fewer than ten (10) days prior to the Rental Period Start Date.

Your rental may be canceled without refund if proof of insurance is not received prior to the required deadline.

ACCEPTANCE OF TERMS AND CONDITIONS


By electronically accepting this quote or submitting payment on this invoice, you acknowledge that you have read, understand, and agree to be bound by the Terms and Conditions of Amanda's Adventures LLC d/b/a Amanda's Glamping set forth above. You further acknowledge that your electronic acceptance constitutes a valid and binding signature under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.) and the Wisconsin Uniform Electronic Transactions Act (Wis. Stat. § 137.11 et seq.), and that a printed copy of this Agreement is not required for it to be enforceable.
